   An act to amend Sections 69101, 69102, 69103, 69104, 69105, 69106,
69580, 69581, 69582, 69583, 69585, 69586, 69591, 69592, 69593,
69594, 69595, 69596, 69598, 69603, 69606, 69610, and 69613 of, and to
repeal Section 69620 of, the Government Code, relating to courts.


	LEGISLATIVE COUNSEL'S DIGEST


   SB 1857, Burton.    Courts:  judges.
   Existing law sets forth the number of judges for the superior
court of each county and for each division of each district of the
court of appeal. Existing law also establishes specific municipal
court districts in Kern County, and the number of judges within these
districts.  Existing law also provides that there are 40 additional
judicial positions in the superior and municipal courts to be
allocated statewide in accordance with a report of the Judicial
Council and appropriations by the Legislature.
   This bill would increase the number of judges in the superior
courts in the Counties of Alameda, Butte, Contra Costa, Fresno, Kern,
Los Angeles, Orange, Riverside, Sacramento, San Bernardino, San
Diego, San Joaquin, San Luis Obispo, Sonoma, Ventura, and Yolo, and
in the superior court in the City and County of San Francisco.  This
bill would increase the number of divisions and judges in the First
and Second Appellate District of the Court of Appeal.  This bill
would also increase the number of judges in the Third, Fourth, Fifth,
and Sixth Appellate Districts of the Court of Appeal.  This bill
would also repeal the provision providing for 40 additional judicial
provisions.
   By imposing additional costs on the counties as a result of the
increased number of judges, the bill would impose a state-mandated
local program.
  The California Constitution requires the state to reimburse local
agencies and school districts for certain costs mandated by the
state.  Statutory provisions establish procedures for making that
reimbursement, including the creation of a State Mandates Claims Fund
to pay the costs of mandates that do not exceed $1,000,000 statewide
and other procedures for claims whose statewide costs exceed
$1,000,000.
   This bill would provide that, if the Commission on State Mandates
determines that the bill contains costs mandated by the state,
reimbursement for those costs shall be made pursuant to these
statutory provisions.


THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:


  SECTION 1.  Section 69101 of the Government Code is amended to
read:
   69101.  The Court of Appeal for the First Appellate District
consists of five divisions having four judges each, and shall hold
its regular sessions at San Francisco.
  SEC. 2.  Section 69102 of the Government Code is amended to read:
   69102.  The Court of Appeal for the Second Appellate District
consists of eight divisions having four judges each.  One division
shall hold its regular sessions in Ventura County, Santa Barbara
County, or San Luis Obispo County, at the discretion of the judges of
that division, and the other divisions shall hold their regular
sessions at Los Angeles.
  SEC. 3.  Section 69103 of the Government Code is amended to read:
   69103.  The Court of Appeal for the Third Appellate District
consists of one division having 11 judges and shall hold its regular
sessions at Sacramento.
  SEC. 4.  Section 69104 of the Government Code is amended to read:
   69104.  The Court of Appeal for the Fourth Appellate District
consists of three divisions.  One division shall hold its regular
sessions at San Diego and shall have 10 judges.  One division shall
hold its regular sessions in the San Bernardino/Riverside area and
shall have seven judges.  One division shall hold its regular
sessions in Orange County and shall have eight judges.
  SEC. 5.  Section 69105 of the Government Code is amended to read:
   69105.  The Court of Appeal for the Fifth Appellate District
consists of one division having 10 judges and shall hold its regular
sessions at Fresno.
  SEC. 6.  Section 69106 of the Government Code is amended to read:
   69106.  The Court of Appeal for the Sixth Appellate District
consists of one division having seven judges and shall hold its
regular sessions at San Jose.
  SEC. 7.  Section 69580 of the Government Code is amended to read:
   69580.  In the County of Alameda there shall be 35 judges of the
superior court.
  SEC. 8.  Section 69581 of the Government Code is amended to read:
   69581.  In the County of Butte there shall be six judges of the
superior court.
  SEC. 9.  Section 69582 of the Government Code is amended to read:
   69582.  In the County of Contra Costa there are 19 judges of the
superior court.
  SEC. 10.  Section 69583 of the Government Code is amended to read:

   69583.  In the County of Fresno there shall be 18 judges of the
superior court.
  SEC. 11.  Section 69585 of the Government Code is amended to read:

   69585.  In the County of Kern there shall be  16 judges of the
superior court.
  SEC. 12.  Section 69586 of the Government Code is amended to read:

   69586.  In the County of Los Angeles there are 239 judges of the
superior court, any one or more of whom may hold court.
  SEC. 13.  Section 69591 of the Government Code is amended to read:

   69591.  In the County of Orange there are 62 judges of the
superior court.
  SEC. 14.  Section 69592 of the Government Code is amended to read:

   69592.  In the County of Riverside there are 27 judges of the
superior court.
  SEC. 15.  Section 69593 of the Government Code is amended to read:

   69593.  In the County of Sacramento there are 35 judges of the
superior court.
  SEC. 16.  Section 69594 of the Government Code is amended to read:

   69594.  In the County of San Bernardino there are 33 judges of the
superior court.
  SEC. 17.  Section 69595 of the Government Code is amended to read:

   69595.  In the County of San Diego there are 72 judges of the
superior court.
  SEC. 18.  Section 69596 of the Government Code is amended to read:

   69596.  In the City and County of San Francisco there are 30
judges of the superior court, any one or more of whom may hold court.

  SEC. 19.  Section 69598 of the Government Code is amended to read:

   69598.  In the County of San Joaquin there are 14 judges of the
superior court.
  SEC. 20.  Section 69603 of the Government Code is amended to read:

   69603.  In the County of Sonoma there shall be 10 judges of the
superior court.
  SEC. 21.  Section 69606 of the Government Code is amended to read:

   69606.  In the County of Ventura there shall be 16 judges of the
superior court.
  SEC. 22.  Section 69610 of the Government Code is amended to read:

   69610.  In the County of Yolo there are five judges of the
superior court.
  SEC. 23.  Section 69613 of the Government Code is amended to read:

   69613.  In the County of San Luis Obispo there are six judges of
the superior court.
  SEC. 24.  Section 69620 of the Government Code is repealed.
  SEC. 25.  Notwithstanding Section 17610 of the Government Code, if
the Commission on State Mandates determines that this act contains
costs mandated by the state, reimbursement to local agencies and
school districts for those costs shall be made pursuant to Part 7
(commencing with Section 17500) of Division 4 of Title 2 of the
Government Code.  If the statewide cost of the claim for
reimbursement does not exceed one million dollars ($1,000,000),
reimbursement shall be made from the State Mandates Claims Fund.
